৪. শারিকাতুল ’ইনান (অসম অংশীদারি কারবার)-এর চুক্তিপত্র
এটি ঐ চুক্তিনামা, যাতে অমুক, অমুক ও অমুকের শরীকী কারবারের বিবরণ রয়েছে। যা তারা স্বজ্ঞানে, স্বেচ্ছায় ত্রিশ হাজার খাটি দিরহামের শরীকী কারবারের ব্যাপারে লিখেছে। তাদের এ যৌথ কারবার ’ইনান’ জাতীয়, মুফাওয়াযা জাতীয় নয়। তাদের প্রত্যেকে দশ হাজার দিরহাম করে দিয়েছে। তাতে মোট ত্রিশ হাজার হয়েছে। তার প্রতি দশ দিরহাম সাত মিসকাল ওজনের। এখন প্রত্যেকের হাতে ঐ মিশ্রিত দিরহামের তৃতীয়াংশ রয়েছে। এরা প্রত্যেকে আল্লাহকে ভয় করে, প্রত্যেকে অন্যের আমানত আদায় করার ব্যাপারে। যত্নবান থেকে পরিশ্রম করবে এবং মিলেমিশে মাল ক্রয় করবে এবং যে মালের ব্যবসা করার ইচ্ছা করবে, সেই মাল নগদ বা বাকীতে ক্রয় করতে পারবে। আর যদি পৃথক পৃথকভাবে অথবা একত্রে ক্রয় করে, তবুও তা সকলের উপর প্রযোজ্য হবে। এক্ষেত্রে তাদের কোন একজনের উপর কোন দায় বর্তালে তা অপর দুই শরীকের উপরেও বর্তাবে। পরে আল্লাহ যা লাভ দেবেন, তা এ দলীলে বর্ণিত মূলধন অনুযায়ী সমহারে অংশীদারদের মধ্যে বণ্টন হবে। আর যদি ক্ষতি হয়, তবে তা-ও মূলধনের ন্যায় সবার উপর বর্তাবে। এই চুক্তিপত্রের তিন কপি একই রকম একই শব্দের সাথে লিখে প্রত্যেক অংশীদারকে দলীল স্বরূপ দেয়া হবে এবং এতে প্রত্যেকের স্বাক্ষর নিতে হবে।
৫. শারিকাতুল- মুফাওয়াযা (সমঅংশীদারি কারবার)-এর চুক্তিপত্র
আল্লাহ তা’আলার বাণীঃ (يَا أَيُّهَا الَّذِينَ آمَنُوا أَوْفُوا بِالْعُقُودِ) অর্থঃ হে ঈমানদারগণ! তোমরা অঙ্গীকার পূর্ণ করবে। ইহা ঐ চুক্তিনামা, যার মাধ্যমে অমুক, অমুক, অমুক এবং অমুক ব্যক্তি অংশীদার হবে ঐ মূলধনে যা তারা একই শ্রেণীর মুদ্রায় জমা করার পর, মিলিয়ে ফেলেছে এবং তা তাদের নিকট মিশ্ৰিতাকারে আছে। ফলে তা পৃথকভাবে চেনা যায় না; এতে সকলের অংশ ও অধিকার সমান। অল্প বিস্তর যাই হোক, এতে তারা সকলে সমভাবে কাজ করবে তা বেচাকেনা, ব্যবসা-বাণিজ্য ও যে কোন কারবারই হোক না কেন। এমননিও তা নগদ হোক বা বাকী, সকলে মিলে হোক বা একাকী ক্রয়-বিক্রয় করবে। আর এই অংশীদারিত্বের পরিপ্রেক্ষিতে প্রত্যেক শরীকের হক বা দেনা প্রত্যেকের উপর বর্তাবে, যাদের নাম ঐ চুক্তিপত্রে উল্লেখ রয়েছে। যদি আল্লাহ তাআলা সকলকে অথবা একজনকে লাভ দেন, তবে তা সকলের মধ্যে সমানভাবে বন্টিত হবে। আর ক্ষতিও সকলের উপর বর্তাবে। আর ঐ বর্ণিত ব্যক্তিগণ প্রত্যেকেই একে অন্যকে উকিল নিযুক্ত করলো। প্রত্যেকের পাওনা আদায় করা, ফরয আদায় করা বা মামলা ও আদায়ের উত্তর দেয়ার জন্য এবং প্রত্যেকে অন্যকে নিজের মৃত্যুর পর কর আদায়, ওসীয়ত পূর্ণ করা ইত্যাদির ব্যাপারে স্বীয় উকিল নিযুক্ত করলো। প্রত্যেকেই অন্যের কাজ স্বীকার করলো, অমুক, অমুক, অমুক এবং অমুক ব্যক্তি এ সকল কথার অঙ্গীকার করলো। অতঃপর তারা সকলে এতে দস্তখত করবে।
৩৯৩৯. আমর ইবন আলী (রহঃ) ... আবদুল্লাহ্ (রাঃ) থেকে বর্ণিত। তিনি বলেন, বদর যুদ্ধের দিন আমি, আম্মার এবং সা’দ এ কথায় শরীক হলাম যে, আমরা যা পাব তা নিজেদের মধ্যে বণ্টন করে নেব। সা’দ (রাঃ) দু’জন কয়েদী পেলেন, আর আমি এবং আমার কিছুই পেলাম না।
بَاب شَرِكَةِ الْأَبْدَانِ
هَذَا مَا اشْتَرَكَ عَلَيْهِ فُلَانٌ وَفُلَانٌ وَفُلَانٌ فِي صِحَّةِ عُقُولِهِمْ وَجَوَازِ أَمْرِهِمْ اشْتَرَكُوا شَرِكَةَ عَنَانٍ لَا شَرِكَةَ مُفَاوَضَةٍ بَيْنَهُمْ فِي ثَلَاثِينَ أَلْفَ دِرْهَمٍ وُضْحًا جِيَادًا وَزْنَ سَبْعَةٍ لِكُلِّ وَاحِدٍ مِنْهُمْ عَشَرَةَ آلَافِ دِرْهَمٍ خَلَطُوهَا جَمِيعًا فَصَارَتْ هَذِهِ الثَّلَاثِينَ أَلْفَ دِرْهَمٍ فِي أَيْدِيهِمْ مَخْلُوطَةً بِشَرِكَةٍ بَيْنَهُمْ أَثْلَاثًا عَلَى أَنْ يَعْمَلُوا فِيهِ بِتَقْوَى اللَّهِ وَأَدَاءِ الْأَمَانَةِ مِنْ كُلِّ وَاحِدٍ مِنْهُمْ إِلَى كُلِّ وَاحِدٍ مِنْهُمْ وَيَشْتَرُونَ جَمِيعًا بِذَلِكَ وَبِمَا رَأَوْا مِنْهُ اشْتِرَاءَهُ بِالنَّقْدِ وَيَشْتَرُونَ بِالنَّسِيئَةِ عَلَيْهِ مَا رَأَوْا أَنْ يَشْتَرُوا مِنْ أَنْوَاعِ التِّجَارَاتِ وَأَنْ يَشْتَرِيَ كُلُّ وَاحِدٍ مِنْهُمْ عَلَى حِدَتِهِ دُونَ صَاحِبِهِ بِذَلِكَ وَبِمَا رَأَى مِنْهُ مَا رَأَى اشْتِرَاءَهُ مِنْهُ بِالنَّقْدِ وَبِمَا رَأَى اشْتِرَاءَهُ عَلَيْهِ بِالنَّسِيئَةِ يَعْمَلُونَ فِي ذَلِكَ كُلِّهِ مُجْتَمِعِينَ بِمَا رَأَوْا وَيَعْمَلُ كُلُّ وَاحِدٍ مِنْهُمْ مُنْفَرِدًا بِهِ دُونَ صَاحِبِهِ بِمَا رَأَى جَائِزًا لِكُلِّ وَاحِدٍ مِنْهُمْ فِي ذَلِكَ كُلِّهِ عَلَى نَفْسِهِ وَعَلَى كُلِّ وَاحِدٍ مِنْ صَاحِبَيْهِ فِيمَا اجْتَمَعُوا عَلَيْهِ وَفِيمَا انْفَرَدُوا بِهِ مِنْ ذَلِكَ كُلُّ وَاحِدٍ مِنْهُمْ دُونَ الْآخَرَيْنِ فَمَا لَزِمَ كُلَّ وَاحِدٍ مِنْهُمْ فِي ذَلِكَ مِنْ قَلِيلٍ وَمِنْ كَثِيرٍ فَهُوَ لَازِمٌ لِكُلِّ وَاحِدٍ مِنْ صَاحِبَيْهِ وَهُوَ وَاجِبٌ عَلَيْهِمْ جَمِيعًا وَمَا رَزَقَ اللَّهُ فِي ذَلِكَ مِنْ فَضْلٍ وَرِبْحٍ عَلَى رَأْسِ مَالِهِمْ الْمُسَمَّى مَبْلَغُهُ فِي هَذَا الْكِتَابِ فَهُوَ بَيْنَهُمْ أَثْلَاثًا وَمَا كَانَ فِي ذَلِكَ مِنْ وَضِيعَةٍ وَتَبِعَةٍ فَهُوَ عَلَيْهِمْ أَثْلَاثًا عَلَى قَدْرِ رَأْسِ مَالِهِمْ وَقَدْ كُتِبَ هَذَا الْكِتَابُ ثَلَاثَ نُسَخٍ مُتَسَاوِيَاتٍ بِأَلْفَاظٍ وَاحِدَةٍ فِي يَدِ كُلِّ وَاحِدٍ مِنْ فُلَانٍ وَفُلَانٍ وَفُلَانٍ وَاحِدَةٌ وَثِيقَةً لَهُ أَقَرَّ فُلَانٌ وَفُلَانٌ وَفُلَانٌ - قَالَ اللَّهُ تَبَارَكَ وَتَعَالَى يَا أَيُّهَا الَّذِينَ آمَنُوا أَوْفُوا بِالْعُقُودِ هَذَا مَا اشْتَرَكَ عَلَيْهِ فُلَانٌ وَفُلَانٌ وَفُلَانٌ وَفُلَانٌ بَيْنَهُمْ شَرِكَةَ مُفَاوَضَةٍ فِي رَأْسِ مَالٍ جَمَعُوهُ بَيْنَهُمْ مِنْ صِنْفٍ وَاحِدٍ وَنَقْدٍ وَاحِدٍ وَخَلَطُوهُ وَصَارَ فِي أَيْدِيهِمْ مُمْتَزِجًا لَا يُعْرَفُ بَعْضُهُ مِنْ بَعْضٍ وَمَالُ كُلِّ وَاحِدٍ مِنْهُمْ فِي ذَلِكَ وَحَقُّهُ سَوَاءٌ عَلَى أَنْ يَعْمَلُوا فِي ذَلِكَ كُلِّهِ وَفِي كُلِّ قَلِيلٍ وَكَثِيرٍ سَوَاءً مِنْ الْمُبَايَعَاتِ وَالْمُتَاجَرَاتِ نَقْدًا وَنَسِيئَةً بَيْعًا وَشِرَاءً فِي جَمِيعِ الْمُعَامَلَاتِ وَفِي كُلِّ مَا يَتَعَاطَاهُ النَّاسُ بَيْنَهُمْ مُجْتَمِعِينَ بِمَا رَأَوْا وَيَعْمَلَ كُلُّ وَاحِدٍ مِنْهُمْ عَلَى انْفِرَادِهِ بِكُلِّ مَا رَأَى وَكُلِّ مَا بَدَا لَهُ جَائِزٌ أَمْرُهُ فِي ذَلِكَ عَلَى كُلِّ وَاحِدٍ مِنْ أَصْحَابِهِ وَعَلَى أَنَّهُ كُلُّ مَا لَزِمَ كُلَّ وَاحِدٍ مِنْهُمْ عَلَى هَذِهِ الشَّرِكَةِ الْمَوْصُوفَةِ فِي هَذَا الْكِتَابِ مِنْ حَقٍّ وَمِنْ دَيْنٍ فَهُوَ لَازِمٌ لِكُلِّ وَاحِدٍ مِنْهُمْ مِنْ أَصْحَابِهِ الْمُسَمَّيْنَ مَعَهُ فِي هَذَا الْكِتَابِ وَعَلَى أَنَّ جَمِيعَ مَا رَزَقَهُمْ اللَّهُ فِي هَذِهِ الشَّرِكَةِ الْمُسَمَّاةِ فِيهِ وَمَا رَزَقَ اللَّهُ كُلَّ وَاحِدٍ مِنْهُمْ فِيهَا عَلَى حِدَتِهِ مِنْ فَضْلٍ وَرِبْحٍ فَهُوَ بَيْنَهُمْ جَمِيعًا بِالسَّوِيَّةِ وَمَا كَانَ فِيهَا مِنْ نَقِيصَةٍ فَهُوَ عَلَيْهِمْ جَمِيعًا بِالسَّوِيَّةِ بَيْنَهُمْ وَقَدْ جَعَلَ كُلُّ وَاحِدٍ مِنْ فُلَانٍ وَفُلَانٍ وَفُلَانٍ وَفُلَانٍ كُلَّ وَاحِدٍ مِنْ أَصْحَابِهِ الْمُسَمَّيْنَ فِي هَذَا الْكِتَابِ مَعَهُ وَكِيلَهُ فِي الْمُطَالَبَةِ بِكُلِّ حَقٍّ هُوَ لَهُ وَالْمُخَاصَمَةِ فِيهِ وَقَبْضِهِ وَفِي خُصُومَةِ كُلِّ مَنْ اعْتَرَضَهُ بِخُصُومَةٍ وَكُلِّ مَنْ يُطَالِبُهُ بِحَقٍّ وَجَعَلَهُ وَصِيَّهُ فِي شَرِكَتِهِ مِنْ بَعْدِ وَفَاتِهِ وَفِي قَضَاءِ دُيُونِهِ وَإِنْفَاذِ وَصَايَاهُ وَقَبِلَ كُلُّ وَاحِدٍ مِنْهُمْ مِنْ كُلِّ وَاحِدٍ مِنْ أَصْحَابِهِ مَا جَعَلَ إِلَيْهِ مِنْ ذَلِكَ كُلِّهِ أَقَرَّ فُلَانٌ وَفُلَانٌ وَفُلَانٌ وَفُلَانٌ - أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ عَنْ سُفْيَانَ قَالَ حَدَّثَنِي أَبُو إِسْحَقَ عَنْ أَبِي عُبَيْدَةَ عَنْ عَبْدِ اللَّهِ قَالَ اشْتَرَكْتُ أَنَا وَعَمَّارٌ وَسَعْدٌ يَوْمَ بَدْرٍ فَجَاءَ سَعْدٌ بِأَسِيرَيْنِ وَلَمْ أَجِئْ أَنَا وَلَا عَمَّارٌ بِشَيْءٍ
This is a partnership between so and so, and so and so, and so and so, who are in good health, and in full control of their wealth, having formed a partnership with thirty thousand Dirhams, non-counterfeit and weighing seven, each one of them contributing ten thousand Dirhams which they have put together and combined, so that thev are now held in common between them on the basis of three equal shares, on the condition that they will work on the basis of fear of Allah and of honesty, each one of them fulfilling the trust toward each of the others. They will all buy whatever they see fit with it, cash or credit, whatever they see fit of different goods. Each one of them may buy on his own without consulting his companions, whatever he sees fit to buy with cash, he may do so, and whatever he sees fit to buy on credit, he may do so. They may work together, or each may work independently of his partners as he sees fit. All of that is binding on them individually, and on the two others, with regard to decisions taken collectively, or individually. Whatever commitment any of them makes, whether small or great, it is binding on each of the other partners, and is binding on all of them. All bounty and profits that Allah bestows over the capital
amount, which is stated in this contract, is to be divided into three equal parts. Any loss is to be borne
by all three partners proportionate to their capital investment. Three identical copies of this document
have been made, and one given to each of the three partners.

Allah says: 0 you who believe! Fulfill (your) obligations [Al-Ma'idah:1]. This is a partnership formed between so and so, so and so, so and so and so and so, based on capital which they have collected of one type, and currency, and have combined it, so that it is now mixed, and none of them can tell which is his money. The share and rights of each partner are equal, and they will use this money for trade, whether buying or selling, for cash, or on credit, in all transactions, making decisions collectively or
individually, each working independently of the others based on his own opinion, and what he sees fit. Whatever commitment or loan any one of the persons mentioned in this contract makes, then it is binding on each of his companions mentioned in this contract. All bounty and profits that Allah bestows over the capital amount, which is stated in this contract, is to be divided equally between all four. Any loss is to be borne equally by each of them. Each of the four persons mentioned in this contract appoints the others as his deputy (Wakil) who may demand every right, and debt, and deal with every dispute, concerning this contract, to dispute on behalf of the others with anyone who is disputing with them, or seek their dues. And each of them makes the others his executor (to act on his behalf after he dies), pay off his debts, and carry out the instructions in his will.

"I formed a partnership with 'Ammar and Sa'd on the day of Badr. Sa'd brought two prisoners but 'Ammar and I did not bring anything."
